1. Definitions

Contractor - Joint Stock Company "Regional Network Information Center" (JSC RU-CENTER).

Partner of the Contractor (Partner) - an individual person or legal entity that has signed a Multiple Services Contract.

Customer - an individual or legal entity that orders the service of .KZ second-level domain name registration or renewal, Registrar change, Registrant change, Reseller change, and, to that end, enters into a Service Agreement with the Contractor.

Order - a request from the Customer to the Contractor, in a form determined by the Contractor, that contains all the data required for .KZ second-level domain name registration or renewal, Registrar change, Registrant change and Reseller change.

Registration Request - a request submitted by the Contractor (Accredited Registrar's Reseller) in on behalf of a Customer for the registration of a .KZ second-level domain name.

The registration requests may not be assigned by one party to another.

Customer's Contract Account - the set of data on the Customer's payments to the Contractor as well as the services the Contractor has provided to the Customer. Any payment made by the Customer is credited to their Contract Account after the money has been credited to the Contractor's bank account, provided that the Contractor has received from the bank a document identifying the payment.

Electronic payment system (e-payment system) is a system represented by software and hardware infrastructure, to settle financial transactions between the Customer and the Contractor via Internet.

ICANN - the corporation that holds authority for the allocation of domain names and numbers, exercises general control over the system of domain names and the space of IP addresses, including the development of rules, and ensures the efficient operation of root servers.

KZ ссTLD Sponsor  — Kazakhstan Network Information Center

Registry - the central database of a KZ foreign ccTLD, which contains information about registered domain names and corresponding DNS servers, as well as other information required for the registration and delegation of domains.

Registry Operator - the legal entity responsible for the operation of Registry and providing access to the Registry for Registrars so that they can provide domain name registration services.

Registrar - any legal entity accredited by ccTLD Sponsor to provide .KZ second-level domain name registration services and deliver required information to the Registry.

Subcontractor  - Accredited Registrar providing .KZ second-level domain name registrations based on Contractor's requests.

Reseller  – legal entity submitting and accepting to accredited Registrar requests for .KZ second-level domain name registrations.

Registration of a domain name - entry of information about the domain name into the Registry by the Registrar. The period of registration, i.e. the period during which the domain name information is stored in the Registry, is set by the Registrant within the minimum (1 year) and maximum (10 years) limits determined by the relevant Registry. The registration of a domain name can be renewed at a Registrant's request.

Registrant  - the person whose name the domain name is registered in. Registrant defines the rules for using the domain name, bears responsibility for registration payments and renewals as well as for the selection of the domain name, and is liable for any violation of third parties' rights associated with the selection and use of the domain name.

Cancellation of registration (domain name release) - removal of information about the domain name from the Registry.

Domain delegation  - entry and storage of information about the domain name and the corresponding DNS servers on the root servers of the relevant top-level domain.

Registrar change - modification of the information about the Registrar of a domain name in the Registry by the Registry Operator.

Reseller change - modification of the contact information about a domain name in the Registry by the Subcontractor with simultaneous domain name extension; the total period of registration may not exceed 10 (ten) years

Policy  – Terms and conditions of .KZ second-level domain names registrations approved by Kazakhstan Network Information Center and published on the company's official website http://www.nic.kz

Terminology not defined in this Schedule is defined in gTLD and foreign ccTLD Registration Schedule and gTLD and foreign ccTLD Registration Agreement.

2. General provisions

2.1. This Schedule sets out the conditions for providing the services of registration, renewal, Registrar change, Registrant change and Reseller change for .KZ second-level domain names.

2.2. The Contractor provides registration of .KZ domain names under the agreement entered into by and between RU-CENTER and "Registrar R01" (Subcontractor), which is an accredited .KZ registrar.

2.3. The Contractor provides the Customer with the services of registration, renewal, Registrar change, Registrant change and Reseller change for .KZ second-level domain names under the Service Agreement. The conclusion of the Multiple Services Contract is preceded by the Customer's registration on the Contractor's database. The Customer is responsible for selecting and registering individual administrative and technical passwords at the registration on the Contractor's database, for preserving their confidentiality, and for all actions that take place as a result of using the passwords.

2.4. All data provided by the Customer during registration in the Contractor's database and signing an Agreement and generating orders shall be authentic. If the Customer provides false information, the registration of the domain name may be canceled.

2.5. A service order serves Customer's full and unconditional consent with the terms of this Schedule. Order service serves as Customer's consent to pay for the service at the prices valid on the date the order execution is started.

2.6. A service is provided to the Customer based on the Agreement, so long as there is an Order for the service and all the relevant requirements of this Schedule are met.

2.7. The domain registration service shall be deemed provided after the information about the domain name has been entered into the Registry.

2.8. The domain renewal service shall be deemed provided after the records about renewal have been made into Contractor's database and the Registry. The registration will be renewed for the period specified by the Customer, which must be a multiple of one calendar year, starting on the date the registration was previously set to end, the total period of registration may not exceed ten (10) years.

2.9. A service of .KZ Registrar change shall be deemed provided after the information about domain name Registrar in the Registry is changed to CENTROHOST and the records about the domain are made to Contractor's database.

2.10. A service of .KZ Reseller change shall be deemed provided after the information about domain name in the Registry is changed and the records about the domain are made to Contractor's database.

2.11. The service of Registrant change shall be deemed provided after the information in the "Name" or "Organization" field of the Registrant object and Organization Using Domain Name field in the domain name information are modified simultaneously in the Contractor's database.

2.12. The Contractor shall inform the Customer of the fact of service delivery by an e-mail sent to the Customer address. If the motivated Customer's objections set forth in simple language in writing and sent by mail service failed to reach the Contractor's address within 5 (five) calendar days from the date of the above mentioned Contractor's e-mail, the service rendered to the Customer by the Contractor shall be deemed accepted by the Customer.

2.13. Registrant agrees not to hold the Registrar and Subcontractor responsible for the Registry Operator's actions that result in refusal to register a domain name.

2.14. Ordering of .KZ domain name registration, or transfer of domain name from Another Registrar (Registrar change) or another Reseller (Reseller change) directly from the Contractor or through the Registrar's Partner authorized by the Registrant, confirms that the Registrant has read and agrees with the provisions of:

  • "Dispute Resolution Policy" for .KZ second-level domain names, text of "Dispute Resolution Policy" is available on the web server of the KZ TLD Sponsor at: http://www.nic.kz/rules/policy.jsp.
  • "Rules of registration, use and allocation of domain Space in the Kazakhstan segment of Internet", text of "Rules of registration, use and allocation of domain Space in the Kazakhstan segment of Internet" is published on KZ TLD Sponsor's web server at: http://www.nic.kz.

Should "Dispute Resolution Policy" and "Rules of registration, use and allocation of domain Space in the Kazakhstan segment of Internet" be modified, the Registrants become bound by these modifications since they are published on KZ TLD Sponsor's web server.

2.15. In case of Registrant's disagreement with the new version of this Schedule, "Dispute Resolution Policy" and "Rules of registration, use and allocation of domain Space in the Kazakhstan segment of Internet"  Registrant shall notify the Contractor about his request to cancel domain name registration or transfer this domain to another Registrar. Otherwise the Registrant's agreement will be deemed obtained.

2.16. Disputes between Registrant and any third persons arising out of the registration and use of a domain name will be dealt  with by the rules approved by KZ TLD Sponsor. The specified rules are called "Dispute Resolution Policy".

2.17. Registrant agree that domain name registration shall be subject to suspension, cancellation, or transfer pursuant to a decision made according to any specification or policy adopted by ICANN or another authorized party including ccTLD Sponsor, or pursuant to any registrar or registry procedure not inconsistent with ICANN or another authorized party including ccTLD Sponsor, Registry Operator policy or Contractor with a purpose, including, but not limited to:

  • to correct mistakes by Registrar or Registry Operator in registering the name or
  • for the resolution of disputes concerning the domain name or
  • executing judicial decision or
  • preclusion of illegal activity or another activity causing damage to third parties, such as: activity banned by the law of the Russian Federation, including distributing and advertising obscene material, appeals for violence, extremist activities, appeals for overthrowing of government and others, and also the activity harmful to public interest, humanitarian and moral principles, insulting human dignity or religious feelings, etc. In this case Registrar is entitled to estimate Registrant's activity on its own for infringement of the legislation, including the cases when the definition of such activities is not fixed by statutory acts. The definition of pornographic materials is published on the website at: https://www.nic.ru/dns/service/hosting/en/moral_standards.html.

2.18. Changes into this Schedule regarding introduction of new and (or) additional services take effect from their publishing on the Contractor's web server.

3. Registration Terms

3.1. A domain name cannot be registered in any of the following cases:

3.1.1. The domain name has already been registered.

3.1.2. The domain name has been reserved by the Registry.

3.1.3. The domain name does not meet the following requirements:

  • .KZ domain name may contain 1 - 63 characters
  • must begin and end with a letter of the Latin alphabet or a digit.  Intermediate may be Cyrillic characters, numbers or a hyphen.

3.1.4. Data specified by the Customer in the appropriate order are incomplete and (or) false.

3.2. The registration period of a domain name must be a multiple of one (1) year and may not exceed ten (10) years.

4. Processing orders for domain name registration, registrar change registrant change

4.1. The Customer will place Orders for services using the Contractor's web interface. Order forms are provided on the Contractor's website www.nic.ru.

4.2. The Customer can cancel an Order on the Contractor's website in the "Manage your account" panel ("Orders: Processing queue, order removal" link) before the processing of the Order begins.

4.3. An Order is considered ready for processing and starts processing, if the Customer has on its Contract Account the funds sufficient to cover all services listed in the Order. If this condition is not met within three (3) months from the day the Contractor receives the Order, the Order will be cancelled.

4.4. The Contractor will process Orders for the same service (all ready for processing) from different Customers on a first-come basis.

4.5. The Contractor will fulfil Orders on a first-come basis. The sequence in which Orders are fulfilled can be changed on the Contractor's website in the "Manage your account" panel ("Orders", "Processing queue, order removal" link).

4.6. Orders for renewal of any services that require immediate allocation (reservation) of funds in the Contract Account for the renewal have a higher processing priority than orders for new services and Orders for Registrar change, Reseller change from the same Customer.

5. Domain name renewal

5.1. Renewing a domain name ensures the extension of its registration period for any period that is a multiple of one (1) year; the total period of registration may not exceed ten (10) years.

5.2. The Contractor automatically generates Orders for domain name renewal for one (1) calendar year. The Contractor will notify the Customer of the need to renew domain name registration via the standard communication channel two (2) months before the registration expires, so long as the Customer has not cancelled the renewal.

5.3. The Customer may at any time place an Order for renewal of a domain name registration. Orders for this service are placed via the Contractor's website in the "Manage your account" panel ("Renew services" link).

5.4. The Contractor will renew a domain name as long as there is an Order for the renewal and sufficient money in the Customer's Contract Account to cover the renewal service, and the Customer has not cancelled the renewal.

5.5. The Customer may cancel a domain name renewal before the renewal service is provided. Renewals are cancelled on the Contractor's website in the "Manage your account" panel ("Renew services" link). Any renewal cancellation can later be reversed within 20 (twenty) calendar days from the date its registration expires before the registration of the domain name is removed from the Contractor's database and cancellation process is initiated in the Registry or before the domain name is transferred to the Contractor or another party as to the domain name Registrant according to par. 5.7 hereinbelow.

5.6. The absence of cancellation of a domain name renewal indicates the Customer's agreement to the provision of the renewal service and to the Customer's Contract Account being debited for the renewal. The Contract Account will be debited in accordance with par. 6 of this Schedule.

5.7. If the domain name has not been renewed by the Customer within 20 (twenty) calendar days from the expiry date of domain name registration, the Customer agrees that he can lose the rights for the domain and the Contractor is entitled to initiate the cancellation process for such domain in the Registry or to transfer the rights for the domain to the Contractor or another party according to the rules defined by the Contractor.

5.8. If the renewal of a domain name is not paid by the Registrant or the Registrar's Partner authorized by the Registrant before the expiry of the registration period specified in the Registrar's database, the Registrar will suspend the domain delegation with the DNS specified by the Registrant or authorized Registrar Partner.

The delegation suspension procedure is available on the Contractor's web server. Since the moment of suspension of domain delegation with the DNS specified by the Registrant or Registrar Partner authorized by the Registrant, all the http-queries to the Registrant's domain can be forwarded to the Registrar's page to inform about the service suspension.

If the registration is renewed before the information about the domain name is deleted from the Registrar's database, the Registrar will resume the domain delegation with the DNS specified by the Registrant or Registrar Partner authorized by the Registrant.

6. Service payment. Debit for services from the Customer's contract account

6.1. Registrant shall timely pay for the domain name registration and renewal services, as well as Registrar change, Reseller change and Registrant change services. The services payment procedure is determined by the Contractor and published on the Contractor's web server.

6.2. The cost of services is set out in Addendum 2 to the Service Agreement.

6.3. The Contractor may, at its sole discretion, change the cost of the services and the payment procedure.

6.4. In order for the Contractor to generate an invoice, the Contractor shall receive the Customer's request for the invoice. Invoices are requested via the Contractor's website in the "Manage your account" panel ("Payment", "Bills"). The original of the invoice will be sent to the Customer by post:

- if the Customer is a legal entity or a registered sole trader - no later than three (3) working days after the Contractor receives the Customer's request for the invoice;
- if the Customer is an individual - at the Customer's request.

The Customer can print copies of invoices from the "Manage your account" panel of the Contractor's web server.

6.5. In the process of preparing payment documents by the Customer, a reference to the number of the Customer's agreement with the Contractor is required in the "Payment Purpose" section.

6.6. Debit for services from the Customer's contract account

6.6.1. The Contractor keeps a record of Customer's payments and the services provided to the Customer, according to the actual prices of these services, as the Personal account of the Customer's Agreement. Any payment made by the Customer is credited to their Contract Account after the money has been credited to the Contractor's bank account, provided that the Contractor has received from the bank a document identifying the payment.

A Customer can access the information on the Personal account of their Agreement on the Contractor's web server in the "Manage your account" panel (the link "Account balance").

6.6.2. Before the Contractor provides a service to the Customer, funds are allocated in the Customer's Contract Account to pay for the service. Money that is allocated for a service cannot be used to pay for another service.

The Customer may cancel reservation of funds in the Contract Account only if they are allocated for renewal of a service. Reservation can be cancelled by cancelling the service renewal before the payment for the renewal is debited from the Contract Account. Service renewals can be cancelled on the Contractor's website in the "Manage your account" panel ("Renew services" link).

6.6.3. Reservation of funds in the Customer's Contract Account

6.6.3.1. Funds for the services of domain name registration, renewal, Registrar change, Reseller change and Registrant change are allocated in the sequence in which the Contractor receives corresponding Orders.

6.6.3.2. When the Customer places several Orders for domain name renewal, renewal funds will be allocated in the sequence in which the registration of the respective domain names expires (funds for renewal of a domain name whose registration expires first are allocated first), unless if otherwise specified by the Customer using e-payment systems. In this case the service renewal procedure will be established by the Customer as scheduled by the e-payment systems.

6.6.3.3. Funds for a domain name renewal will be allocated in the Customer's Contract Account no earlier than eight (8) calendar days before the domain name registration expires, so long as the Customer has not cancelled the renewal.

6.6.4. The Customer's Contract Account is debited for a domain name renewal within one day after the Customer's Order for the renewal is received or, in the event the Customer has not cancelled the renewal, no earlier than one (1) calendar day before the domain name registration expires.

6.7. Upon termination of a Contract, or if Customer provides reasons why the Customer cannot use the Contractor's services, the remainder of the Customer's money is returned to the Customer by bank transfer to the Customer's account at any bank in the Russian Federation. The Contractor will take all actions that are necessary for the return within 10 (ten) working days from the date the Contractor receives the Customer's written request with full information on the payee's bank account.

6.8. There will be no refund of the fee for any unexpired period of a cancelled domain name registration.

6.9. Customer's obligations for services payment will be deemed unexecuted, if he (she) made a refund upon the request of the payment system by which the Customer paid for the service. In this case the Contractor is entitled to suspend the service for the Customer since the moment of refund, and use the domain name at its own discretion.

7. Registration details

7.1. Mandatory information. For the registration of a .KZ domain name, the Customer shall provide the following information in English:

  • name of the legal entity according to its registration documents - if the Registrant is a legal entity;
  • first, middle and last names according to an ID - if the Registrant is an individual;
  • postal address, telephone number, fax number and e-mail address of the Registrant;
  • domain name;
  • name of the legal entity according to its registration documents and/or first, middle and last names according to an ID, postal address, telephone number, fax number and e-mail address of the administrative, technical and billing contacts for the domain name;
  • IP address and name of DNS servers;
  • servers location information, in particular: address, city, region;
  • other information requested by the Contractor at the request of the relevant Registry or Subcontractor, including information about the purpose of the domain name registration.

7.2. Optional information. In addition to the mandatory information specified in par. 7.1, the Contractor may store the following information about a domain name registration:

  • date of the initial registration of the domain name;
  • date and time when the Contractor receives the domain name registration order and sends the appropriate request to the Subcontractor;
  • electronic archive containing data on orders for new services, modification of information and cancellation of orders, as well as the relevant correspondence between the Contractor and Registrant and/or Partner authorized by the Registrant;
  • information on payments for the domain name made by the Registrant or Partner authorized by the Registrant;
  • date when the registration of the domain name expires;
  • any other information required for the domain name registration.

7.3. All information provided by the Registrant to the Contractor must be factual. The Registrant shall maintain the information up to date and, if necessary, update it independently or through the Contractor's Partner authorized by the Registrant. If the Registrant provides false information or fails to timely update the provided registration information, the registration of the domain name may be cancelled.

7.4. At any time during the registration period of a domain name, the Contractor may request from the Registrant additional information and/or substantiation of previously provided information. Requests are sent via the standard communication channels to the Registrant and/or the Contractor's Partner authorized by the Registrant.

7.5. Registrant agrees that, in the event the additional information is not provided and/or the previously provided information is not substantiated, inaccurate or false data have been submitted, obligations of updating data submitted to Contractor have not been fulfilled within a period specified by the Contractor in appropriate request, the Contractor is entitled to:

а) deny Registrant /or the Registrar's Partner order for new domain name registration;
b) suspend Registrant's domain delegation;
c) deny Registrant and/or the Registrar's Partner order for domain name renewal;
d) reject Registrant's request for domain names transfer to another person or request for domain names transfer to Another Registrar or another Reseller.

All mentioned above restrictions can be removed within 5 (five) calendar days since Registrant provided all necessary information. In case of necessary information is not provided within 5 (five) calendar days after delegation suspension the Contractor is entitled to cancel Registrant's domain registration.

7.6. The Registrant agree that ICANN or another authorized party including KZ ccTLD Sponsor may change existing or introduce new rules, restrictions or requirements with regard to the form and volume of the Registrant's registration information that the Contractor may or must disclose to third parties.

7.7. The Contractor shall provide the Registrant with access to his registration information in the Contractor's database for viewing and modifying fields available for modification via the Contractor's website at www.nic.ru.

8. Change of domain name information

Domain name information - information about a domain name entered into the Registry during domain name registration (details of the Registrant, administrative, technical and billing contacts, DNS servers, servers location).

8.1. Domain name information can only be modified after the Order for registration of the domain name has been successfully completed.

8.2. The procedure of introducing modifications into information about domain name:

- log in to "Manage your account" panel;
- in "Services" menu select "My domains";
- select .KZ domain;
- select "DNS servers", "Whois contacts"; "Servers location", click on "Modify";
- make necessary changes;
- save changes.

Any changes of contacts, DNS servers, servers location in the Contractor's database and in the Registry will come into effect within one (1) hour from the moment they are made.

8.3. Details of the Registrant can be modified by making appropriate changes in the Contractor's database:
in contact details - in the Registrant object,
in identification data - in the Customer's Contract with the Contractor.

8.3.1. Modification of the Registrant's contact details in the Registrant object

The Registrant's contact details include: telephone number, fax number, e-mail addresses, postal address. Changes can be made via the "Manage your account" panel of the Contractor's website.

Procedure of contact data changing:

- log into "Manage your account" panel;
- find the Registrant object in the "Whois Contacts" menu;
- click on "Modify" in the column "Information about object";
- make necessary changes;
- save the changes.

Any changes of the Registrant's contact details will come into effect within one (1) hour from the moment they are made.

8.3.2. Modification of the Customer's identification details in the Agreement

The Customer's identification details include: organization name, legal address, taxpayer identification number, first, middle and last names, passport details, and date of birth. The Customer can modify identification details by sending a formal letter to the Contractor. The form of letter is given on the Contractor's web server.

The Customer's identification details in the Agreement will be changed within two (2) working days from the moment the Contractor receives the Customer's letter.

9. Domain Name Registrant change procedure

9.1. On the basis of notification (letter) from the Registrant of a domain name to the Contractor, the rights to the domain name can be transferred to another legal entity or individual, as long as the notification (letter) meets rules and requirements published on the Contractor website and there is an Order for the Registrant change service and sufficient money in the Customer's Contract Account to cover the service. The notification (letter) form is provided on the Contractor's website.

9.2. When the Contractor receives a notification (letter) from the Registrant of a domain name requesting transfer of the domain name to another person, as well as a confirmation in the form set by the Contractor from that person confirming their intention to become the Registrant, the Contractor will, within two (2) working days, take necessary steps for the domain name transfer and notify thereof losing and gaining Registrants, as long as the service has been paid. At the Contractor's discretion this term could be extended till 30 calendar days.

9.3. The Contractor is entitled, for the justified reasons, to consider domain name transfer invalid.

9.4. Transfer of a domain name to another person does not effect the term of the registration.

9.5. Registrant change cannot be performed, if the domain name renewal is not paid within 20 (thirty) calendar days after the domain name expiration date.

10. Registrar change procedure

10.1. Registrar change (transfer of a domain to or from another Registrar) can only be initiated by the Registrant. The Contractor may at any time ask the Registrant for a written confirmation of any received request for Registrar change.

10.2. Transfer of domain name to the Contractor from another Registrar

10.2.1. Domain name transfer to the Contractor is performed on the basis of an Order for the Registrar change service, so long as there is sufficient money in the Customer's Contract Account to cover the service. The forms for the placement of Orders can be found on the Contractor's web server: https://www.nic.ru

Registrar change performed simultaneously with the domain name transfer is done by sending a formal letter from the Registrant to the Contractor. The form of letter is given on the Contractor's web server.

10.2.2. The Contractor may refuse a request for Registrar change in the following cases:

  • a domain name is in the first 60 days of an initial registration period;
  • a domain name is within 60 days after being transferred from previous Registrar;
  • Registrant has refused to confirm its agreement to the Registrar change or failed to respond within the period set by the Contractor five (5) calendar days for transfers from another Registrar;
  • Change of Registrar, another Registrar does not comply with "Dispute Resolution Policy" in case of doubts about Registrant's identity;
  • there is doubt about Registrant's identity;
  • due to a court's decision;
  • due to an objection from another Registrar maintaining the domain name;

10.2.3. The Contractor does not guarantee the success of any Registrar change. If Registrar change procedure is not provided for any reason, the funds reserved in the Customer's Contract Account to pay for the service will be released.

10.2.4. After processing of the Order begins, the Contractor will request confirmation of the domain name transfer from the Registrant indicated in the current Registrar's Whois data. The request will be sent to the Registrant's contact e-mail addresses specified in the domain name Whois data.

If the Contractor receives the Registrant's agreement to the domain name transfer, the Subcontractor will initiate Registrar change procedure in the Registry.

In the event of the Registrant's refusal to the domain name transfer or absence of response within five (5) days, the Order will be cancelled. The Contractor will give the Customer notice of cancellation (due to the inability to fulfil the Order) within two (2) working days from the cancellation date.

10.2.5. When the Registry receives the Subcontractor's request for Registrar change, the Registry Operator will send a request to the current Registrar. Based on the current Registrar's response, the Registry Operator will make its decision and inform Subcontractor about it. The Registrar change procedure in the Registry may last for up to seven (7) calendar days.

If the Registry Operator makes a positive decision, the Subcontractor will, as a result of Registrar change, become the domain name Registrar, the registration period will be extended by 1 calendar year from the date the registration was previously set to end; the total registration period may not exceed ten (10) years. When the domain name registration expires, the Contractor will undertake its renewal in the Registry in accordance with par. 5 of this Schedule.

In the event of the Registry Operator's refusal to change the Registrar, the Contractor will notify the Customer of the Registry Operator's decision within two (2) working days from the moment the processing of the Order ends.

10.3. Transfer of domain name from the Contractor to another Registrar

When the Contractor is notified by the Registry Operator of the initiation of Registrar change, the Contractor will send a request to the Registrant's contact e-mail address specified in the Contractor's database. The Registrant shall respond to the Contractor's request for the domain name transfer within four (4) calendar days from the moment of the initiation of Registrar change in the Registry.

In the event of Registrant's refusal, Subcontractor will give the Registry notice of refusal to transfer the domain name to Another Registrar.

Upon the Registrar's agreement, Subcontractor will give the Registry notice of agreement to transfer the domain name to Another Registrar.

In the absence of Registrant's response within the period set by the Contractor (four (4) calendar days), the Subcontractor will fail to respond to the Registry Operator's request and, after five (5) calendar days from the day the Registry Operator's request is sent to the Contractor, the Registry Operator will transfer the domain name to Another Registrar.

11. Reseller change procedure

11.1. Domain name transfer to the Contractor from another Reseller

11.1.1. Transfer of domain name to the Contractor is performed on the basis of an Order for Reseller change service, so long as there is sufficient money in the Customer's Contract Account to pay for the service. The forms for the placement of Orders can be found on the Contractor's web server: https://www.nic.ru

Registrant change performed simultaneously with the Reseller change is done by sending a formal letter from the Registrant to the Contractor. The letter form is given on the Contractor's web server.

11.1.2. The Contractor may refuse a Reseller change request in the following cases:

  • Registrant has refused to confirm its agreement to the Reseller change or failed to respond within the period set by the Contractor five (5) calendar days in case of transfer from another Reseller;
  • Change of Reseller, another Reseller does not comply with "Dispute Resolution Policy";
  • there is doubt about Registrant's identity;
  • due to a court's decision;
  • due to an objection from another Reseller maintaining the domain name;
  • . in other cases stipulated by the Dispute Resolution Policy.

11.1.3. The Contractor does not guarantee the success of any change of Reseller. If Reseller change service is not provided for any reason specified in para 11.1.2 hereinabove, the funds reserved in the Customer's Contract Account to pay for the service will be released.

11.1.4. Upon the launch of Order processing, the Contractor will request confirmation of the domain name transfer from the Registrant indicated in the current Registrar's Whois data. The request will be sent to the Registrant's contact e-mail addresses specified in the domain name Whois data.

If the Contractor receives the Registrant's agreement to the domain name transfer, the Contractor will initiate Reseller change procedure.

In the event of the Registrant's refusal to the domain name transfer or absence of response within five (5) days, the order will be cancelled. The Contractor will give the Customer notice of cancellation (due to the inability to fulfil the Order) within two (2) working days from the cancellation date.

11.1.5. If domain transfer procedure from Another Reseller becomes successful, the Contractor will become the domain name Reseller, the registration period will be extended by 1 calendar year from the date the registration was previously set to end; in this case the total registration period may not exceed ten (10) years. When the domain name registration expires, the Contractor will undertake its renewal in the Registry in accordance with par. 5 of this Schedule.

11.2. Domain name transfer from the Contractor to another Reseller

When the Contractor is notified by the Registry of the initiation of Reseller change procedure, the Contractor will send a request to the Registrant's contact e-mail address specified in the Contractor's database. The Registrant shall respond to the Contractor's request for the domain name transfer within four (5) calendar days from the moment of the initiation of Reseller change procedure in the Registry.

In the event of the Registrant's refusal, the Contractor will give notify the Subcontractor of refusal to transfer the domain name to another Reseller.

Upon the Registrant's agreement, the Contractor will give the Subcontractor notice of agreement to transfer the domain name to another Reseller.

In the absence of the Registrant's response within the period set by the Contractor of 5 (five) calendar days from the moment of Reseller change launch, Subcontractor will transfer the domain name to another Reseller.

12. Transfer from the Contractor to Contractor's Partner. Change of Partner. Transfer from Partner to Contractor

12.1. The Customer may receive the Contractor's services from the Contractor's Partner.

12.2. The duties to assist in the registration and renewal of the Customer's domain names from the Contractor to the Contractor's Partner can be transferred by submitting a formal letter or by submitting request using the Contractor's web server, the "Manage your account" panel ("Transfer to partner" link).

12.3. When the Contractor receives the letter from the Customer, it will, within two (2) working days, take all-out efforts to transfer the duties mentioned in par. 12.2 hereinabove.

If the Contractor receives from the Customer a request submitted through the Contractor's web interface, the Contractor will transfer the responsibilities specified in paragraph 12.2 hereinabove within one hour from the moment of request receipt.

The Contractor notifies the Customer and the Partner about changes via the standard communication channels.

12.4. From the moment the duties mentioned in par. 12.2 are transferred from the Contractor to another person, the contractual relationship between the Contractor and the Customer is temporarily ceased. They may be resumed through the Customer's special request to the Contractor in the form set by the Contractor.
