1. Definitions

A Domain is an area of the Internet hierarchical name space, which is denoted by a unique domain name, served by a set of Domain Name Servers (DNS), and administered autonomously by a Registrant. Each registered domain name is assigned to a single Registrant.

The Registry is the database of the second level domain, which contains information on the registered third-level domain names and their Registrants, and other information required for the third-level domain registration.

Second-level domain Sponsor is a legal entity, in whose name the domain is registered.

The Contractor — Joint Stock Company "RU-CENTER".

A Partner is an individual person or legal entity that has signed a Multiple Services Contract.

A Customer is a Partner.

Domain name registration means entry of the information about a third-level domain name and its Registrant on the Registry by a the Contractor following an Applicant's Application. A third-level domain name is considered registered from the moment the information is entered on the Registry. Domain name details are stored in the Registry for the domain registration term until "paid-till" date specified in the Registrar's Whois-service.The registration of a third-level domain can be repeatedly renewed for another year.

The third-level domain Registrant (domain name owner) is the person in whose name the third-level domain is registered. The third-level domain Registrant defines the rules and order of using this domain name, is responsible for selecting the domain name and for possible violations of the rights of any third party in connection with the selection and use of the domain name, and is liable for the costs of such violations.

The Administration of a third-level domain means definition, by the third-level domain Registrant, of the rules and order of using the third-level domain name, management and technical support of the domain operation.

Cancellation of registration is removal of the information on a third-level domain name and its Registrant from the Registry.

Third-level domain delegation is placement and storage of the information about a third-level domain name and its domain name servers (DNS servers) on the root DNS servers of the RU domain, which enables the operation of the third-level domain on the Internet. The delegation of a third-level domain is only possible during the registration term of this domain.

An Application (Order) is a request of an Applicant to the Contractor which is made on a form given by the Contractor and contains the information required for the registration (registration renewal) of a third-level domain name.

Customer's Contract Account is a record of the Customer's payments to the Contractor as a Registrar, as well as the Customer's expenses for services provided by the Contractor. Any payment made by a Customer is added to the Personal account of the Multiple Services Contract after the money has been credited to the Contractor's bank account and the Contractor has received from the bank a document identifying the payment.

Blocking of Funds on Customer's Contract Account — reservation of an amount on the Customer's contract account for the purpose of its further withdrawal on account of service delivery or renewal. The funds reserved for the service delivery or renewal may not be used for payment of other services.

Electronic payment system (e-payment system) is a system represented by software and hardware infrastructure, to settle financial transactions between the Customer and the Contractor via Internet.

Note: The terms uncovered by this Schedule are defined in documents "Third-level Domains Maintenance Policy" and "Third-level Domains Maintenance Policy in COM.RU, NET.RU, ORG.RU and PP.RU Domains".

2. General Provisions

2.2. The Contractor, as a sponsor of second-level domains RU.NET, EXNET.SU, provides the services for renewal of domain names registration in third-level domains in RU.NET, EXNET.SU.

2.3. RU-NIC has become a Registrar of .NET.RU, .ORG.RU and .PP.RU domain names under contract 244/POC-L dated December 22, 2010 between RU-NIC and RIPN, second-level domains sponsor.

2.4. The Contractor provides services to a Customer that has signed a Multiple Services Contract with the Contractor. Entering into a Contract is preceded by the procedure of registering the Customer on the Contractor's database. All information provided by Customer in connection with the Contract must be true, current, accurate, and complete. The Customer is responsible for selecting and registering individual administrative and technical passwords during the registration on the database, for securing their confidentiality, and for all actions that involve using the passwords.

2.5. A Customer agrees that any information the Customer provides by filling in applications and other documents, including those in an electronic form, under sections of these documents marked as "open", will be placed by the Contractor on the search engines and will be open to the general public. A list of the information that is bound to be published and published with the Customer's consent, can be found at the Contractor's Web server.

2.6. An Order for a service indicates that the Customer agrees to pay for the service at the price effective at the date the processing of the Order begins.

2.7. A service of third-level domain name registration is deemed provided from the moment the information on the third-level domain and its Registrant is entered on the Registry.

2.8. A service of renewing the registration of a third-level domain is deemed provided from the moment the information on the renewal is entered on the Registry. The domain registration is prolonged on 1 (one) year from earlier installed date of completions a term of registrations.

2.9. The Contractor shall inform the Customer on the fact of rendering the service by an e-mail sent to the Customer address. If the motivated Customer's objections set forth in simple language in writing and sent by mail service failed to reach the Contractor's address within 15 (fifteen) calendar days from the date of the abovementioned Contractor's e-mail, the service rendered to the Customer by the Contractor is considered to be accepted by the Customer.

2.10. The form of any official letter is set by the Contractor and is available at its web-server http://ww.nic.ru/. The letters should be sent to the following address:

2.11. A Customer shall follow requirements of Terms of Use which are available at the Contractor's server https://www.nic.ru/about/en/servpol.html. The Customer agrees that he could be affected by consequences of actions applied by the Contractor for prevention of the adverse effects of third party activity impairing the operation of the Contractor Service system. In its actions the Contractor follows provisions of Terms of Use and guarantees the minimization of such adverse effects to the Customer.

3. Registration and Delegation Terms

3.1. Registration Terms

3.1.1. The Contractor registers a domain name upon receipt from the Customer an Order which is ready to be processed in accordance with paragraph 4.2 of this Schedule.

3.1.2. A third-level domain name cannot be registered in any of the following cases:

3.1.2.1. The third-level domain name has already been registered.

3.1.2.2. The third-level domain name does not meet any of the following requirements:

  • a third-level domain name must contain from 2 to 63 characters beginning with and ending in a character from the Latin alphabet or a digit; letters, digits and hyphens may be used in other positions in-between; it is not allowed to specify hyphens in the third and the fourth positions simultaneously;
  • the third-level domain name must not contain words that are inconsistent with the public interest, principles of humanity, and public morals (in particular, obscenities and appeals of violent nature that offend human dignity or religious feelings etc.).

3.1.2.3. Subject to the section 3.3.3.

3.2. Delegation Terms

3.2.1. A third-level domain may only be delegated with the DNS servers list specified by the Customer after receiving positive results of a validity check on the domain name servers (primary and secondary DNS servers) that, as specified by the Customer, hold the configuration files of the third-level domain.
The DNS servers specified by the Customer must have reliable connection to the Internet. A "reliable connection" implies that the total time for which the server is not connected to the Internet does not exceed two hours a day. These servers must be maintained in conformity with the requirements of the international standards RFC-1032, RFC-1033, RFC-1034, RFC-1035 and RFC-1591.

If positive results of the validity check on the third-level domain name servers are not received within 4 (four) days, the check is ceased. The procedure of testing the DNS servers can be initiated again by the Customer using the Contractor's Web interface.

3.2.2. The information on third-level domain name servers must correspond to the current state of the network.

3.2.3. In the case of any breach of the provisions in the sections 3.2.1 and 3.2.2 hereinabove, the Contractor may suspend the delegation of a domain at any time during the registration term. The delegation can only be resumed after the breach is corrected.

3.3. Special provisions

3.3.1. Registering a third-level domain name a Customer provides to the Contractor's database the information on the Registrant (fills in an application form), selects and registers individual administrative and technical passwords, informs the Registrant on the passwords and the number of Registrant's form assigned by the Contractor.

3.3.2. All provided by the Customer information concerning the Registrant must be true, current, accurate, and complete. If there is any doubt about the authenticity of the information concerning the Registrant provided by the Customer for the third-level domain name registration, the Contractor may demand confirmation of the data and/or request additional information during the entire term of the registration. Such requests are sent via e-mail to the Customer's contact address specified in the Contract.

3.3.3. If the previously provided information is not confirmed and/or additional information is not provided within the term specified by the Contractor in the respective request, the Contractor may:

a) reject application for new third-level domain name registration for the Registrant;
b) suspend the delegation of the Registrant's third-level domain names;
c) reject application for third-level domain names renewal;
d) reject Registrant's request for third-level domain names transfer to another person or request for domain names transfer to another Registrar.

The said restrictions could be canceled within 3 (three) working days after receiving the required information.

If the required information is not provided within 60 (sixty) calendar days from the moment of suspending the Contractor is entitled to cancel registration of the Registrant's third-level domain names.

3.3.4. To transfer a third-level domain name to another juristic or natural person, to cancel a third-level domain name registration upon the Domain Registrant request the Customer must provide the Contractor with documents which are published at www.nic.ru web-server appropriate sections. All Domain Registrant identifying data specified in the provided documents must be identical to the data specified by the Domain Registrant while registering in the Contractor's database.

3.3.5. Cancellation of third-level domain name registration before registration term is expired

3.3.5.1. The registration of a third-level domain name is terminated before the expiry of the registration term in the following cases:

a) by reason of the Registrant's written request with the exception of cases described in 3.3.5.2 section of this Schedule;
b) subject to the section 3.3.3 hereof;
c) according to valid judgment

  • admitting a fact that the administration of the third-level domain by its Registrant violates the rights of a complaint;
  • and/or prohibiting the use of a designation belonging to or licensed to a complaint in the third-level domain name.

In such cases, the person whose rights the court has found infringed is given priority in registration of the cancelled third-level domain name. To realize its priority the person shall send a written request to the Contractor's address not later than 60 (sixty) calendar days after the court decision becomes effective.

d) Subject to the section 3.1.2.2.

3.3.5.2. Third-level domain name registration will not be canceled before its expiry term upon a written request of the Registrant within 60 (sixty) calendar days after:

  • obtaining third-level domain ownership by the Registrant from another person, or
  • obtaining third-level domain ownership by the Registrant as a result of third-level domain transfer made under the "Third-Level Domains Maintenance Policy".

4. Order Processing

4.1. A Customer may place Orders for new services

  • using the Contractor's Web interface. The forms for the placement of Orders are available at the Contractor's Web server in the section "Manage your account";
  • by e-mail request. The forms of requests are available at the Contractor's Web server in the section "Manage your account";
  • by http request. The forms of requests are available at the Contractor's Web server in the section "Manage your account";

4.2. An order is processed if the Customer has signed a Contract with the Contractor and the funds in the Personal account of the Contract are sufficient to pay for all services of the Order. Any Order that cannot be processed within 3 months will be deleted.

4.3. If there are several Orders for the same service from different Customers, such Orders are processed on a first-come basis.

4.4. Different Orders for new services from the Customer are processed on a first-come basis. The sequence in which the Orders are processed can be changed at the Contractor's Web server in the section "Manage your account" (the link "Processing queue, order removal").

4.5. During the period of the reservation of money in the Personal account of a Contract for any service renewal, an Order for this renewal has priority in processing over any Orders for new services placed by the Customer.

4.6. the Contractor examines Orders for the compliance with the conditions set forth in this Schedule. During the period of examination of an Order the Contractor may request the Customer to provide additional information required for the examination.

4.7. the Contractor's decision to register a third-level domain name or to refuse the registration will be based on a reason provided for in this Schedule.

4.8. If there is any doubt, for a reason specified in this Schedule, whether the registration of a third-level domain is possible, the Contractor may suspend the registration of the third-level domain name for a period of 15 (fifteen) days. After that the Contractor must register the third-level domain or issue a reasoned refusal of the registration.

4.9. If there is a reason for the refusal of registration the Contractor will inform the Customer about the impossibility of the third-level domain name being registered and the reason for this refusal. the Contractor, whenever possible, may choose not to refuse third-level domain registration, but to register it in the Contractor's name with further domain transfer to the Customer since the latter meets the requirements of the present Schedule.

4.10. A decision about registration, refusal of registration, or registration suspension is sent to the Customer within 2 (two) working days from the moment the processing of the Order begins.

5. Registration Renewal

5.1. A third-level domain name registration renewal ensures storage of the information concerning the domain name on the Registry for the period of one year.

5.2. The third-level domain name renewal can be made with:

a) the Order for the third-level domain registration renewal submitted by the Customer to the Contractor or
b) "automatic renewal" function.

5.3. A Customer can cancel the "automatic renewal" not later than thirty (30) calendar days before the third-level domain's expiration date.

5.4. Renewal procedure

5.4.1. the Contractor notifies a Customer of the necessity to renew the third-level domain name registration 2 (two) months before the expiration date of the third-level domain. The notification is sent via e-mail to the Customer's contact address specified in the Contract. The Contractor has the right to notify the Registrant previously to third-level domain delegation suspension and third-level domain name registration termination.

5.4.2. A third-level domain name registration renewal is processed if the Customer has submitted to the Contractor the Order for the registration renewal service or if the Customer uses the "automatic renewal" function and the funds in the Personal account of the Contract are sufficient to pay for the service.

5.4.3. An Order for the registration renewal service may be submitted to the Contractor in 2 (two) months before expiration date, but no later than 120 (one hundred and twenty), 90 (ninety) or 30 (thirty) calendar days after expiration, subject however to registration expiry date, as per item 5.7. The Customer may place the Order at the Contractor's web-server in the section "Manage your account" (the link "Renew services").

5.5. If a Customer uses the "automatic renewal" function, the Contractor proceeds with the renewal request thirty (30) calendar days before the expiration date. To use the "automatic renewal" function a Customer has to fill a form in the "Manage your account" section on the Contractor's web-server or to send an http request or e-mail request to the Contractor. The forms of all the requests can be found in the "Manage your account" section on the Contractor's web-server.

5.6. The Contractor suspends the delegation of a third-level domain with the DNS servers list specified by the Customer if the registration of the third-level domain is not renewed by the Customer before the registration term ends. Since the moment all the http requests to the Customer's domain can be redirected to the Contractor's service page to inform about the service suspension.

If the third-level domain name renewal is paid within 120 (one hundred and twenty), 90(ninety) or 30 (thirty) days after expiration, subject however to registration expiry date, as per item 5.7 and the Customer confirms the third-level domain name renewal order, the third-level domain name registration term is extended for 1 (one) year of expiration date and the third-level domain is reactivated within 2 (two) business days after the payment received. The renewal costs will be calculated according to the tariffs actual on the date of the service expiry.

5.7. The Contractor terminates the registration of a third-level domain if it is not renewed by the Customer within:

  • 120 (one hundred and twenty) calendar days. The specified period is valid for the domains scheduled to release within the period of October 5 . November 1, 2011 inclusive,
  • 90 (ninety) calendar days from the registration expiry date. The specified period is valid for the domains to expire before March 31, 2012 inclusive,
  • 30 (thirty) calendar days from the registration expiry date. The specified period is valid for the domains to expire after March 31, 2012.

5.8. The Contractor has the right to notify a third-level domain name Registrant of the domain delegation suspension or domain deletion in advance, by e-mail.

5.9. A third-level domain name registration is not extended by the Contractor subject to the section 3.3.3 hereof.

6. Service Payment

6.1. The cost of services is specified in the Multiple Services Contract.

6.2. The Contractor keeps a record of Customer's payments and the services provided to the Customer, according to the actual prices of these services, as the Personal account of the Customer's Multiple Services Contract. Any payment made by a Customer is added to the Personal account after the money has been credited to the Contractor's bank account and the Contractor has received from the bank a document identifying the payment.

A Customer can access the information on the Personal account at the Contractor's Web server in the section "Manage your account" (link "Account balance").

6.3. Invoicing

6.3.1. The Contractor will invoice a Customer upon receiving an appropriate request from the Customer. The request for an invoice is made by the Customer at the Contractor's Web server in the section "Manage your account". On condition that the Customer has signed a Multiple Services Contract with the Contractor, the original of the invoice will be sent to the Customer by post:

  • for legal entities — within 3 (three) working days after the Contractor receives the Customer's request for the invoice;
  • for individuals — as requested by the Customer.

A copy of an invoice can be printed by the Customer at the Contractor's Web server in the "Manage your account" section.

6.3.2. A Customer shall put the number of their Contract with the Contractor in the section "Payment Subject" of any payment document prepared by the Customer.

6.4. Customer's Money Reservation

6.4.1. The Contractor provides a Customer with a service after reserving sufficient money in the Customer's Contract Account. Money that is reserved for a service cannot be used to pay for another service.

6.4.2. If money is reserved to pay for a service renewal and the service has not been renewed yet, the Customer can remove the blockage by canceling the renewal. A renewal of a service can be cancelled at the Contractor's Web server in the "Manage your account" section (link "Renew services").

6.4.3. The funds for several new services of domain registration ordered by the Customer are blocked in the sequence in which the Orders for these services are placed.

6.4.5. If several Orders for domain renewal are placed by the Customer, the funds for the services are blocked in the sequence in order expiration date (the funds for a service whose term expires earlier are blocked earlier), unless if otherwise specified by the Customer using e-payment systems. In this case the service renewal procedure will be established by the Customer as scheduled by the e-payment systems.

6.5. The funds for the service of a domain name registration renewal are debited from the Personal account of the Customer's Contract after 00.00 MSK/MSD at the last day of the month when the Order for renewal is received. If the Order for renewal is received at the last day of the month the funds are debited from the Personal account next month.

6.6. Upon termination of a Multiple Services Contract, or if a Customer provides reasons why the Customer cannot use the Contractor's services, the remainder of the Customer's money is refunded to the Customer by bank transfer to the Customer's account at any bank in the Russian Federation. The Contractor will take all-out actions to make a refund within 10 (ten) working days from the date the Contractor receives the Customer's written request with full information on the payee's bank account.

6.7. There will be no refund of the fee for any unexpired period of a cancelled domain name registration.

6.8. Customer's obligations for services payment will be deemed unexecuted, if he (she) made a refund upon the request of the payment system, by which the Customer paid for the service. In this case the Contractor is entitled to suspend the service for the Customer since the moment of refund, and use the domain name at its own discretion.

7. Data Update

7.1. Updating DNS servers

Any updates may be introduced at the Contractor's web server in the following sequence:

  • log into the section "Manage your account",
  • select "Review and update data" in the section "Services",
  • find the service whose parameters are being modified,
  • choose necessary link on the column "Modify parameters",
  • make necessary changes, and
  • save the changes.

7.2. Updating Registrant's Data in the Registry

The Registrant's data in the Registry are updated by modifying the data in his Registrant's form.
The Registrant's data in the Registry will be automatically updated within 2 hours since modification of the Registrant's data in the Registrant's form.

7.3. Updating Data in the Registrant's Form

The Registrant's contact and identification data (hereinafter referred to as Registrant's data) in his Registrant's form may only be modified after the Order for registration of the third-level domain has been successfully processed. The Registrant shall thereby ensure the authenticity of any data provided as part of the Agreement.

7.3.1. Updating Registrant's Contact Data

The Registrant's contact data are: telephone number, fax number, e-mail addresses, postal address. Any updates are initiated at the Contractor's Web server by one of the below methods:

a) at the Contractor's web server in the following sequence:

  • log into section "Manage your Account",
  • in menu "Contract"select item "Customer list" and search the Registrant's form to be modified;
  • find the form with the parameters to be modified,
  • choose "Change" link in column "Form data",
  • make appropriate changes, and
  • save the changes.

b) by e-mail request: the forms of requests are available at the Contractor's Web server in section "Manager your Account";

c) by HTTP requests: the forms of requests are available at the Contractor's Web server in section "Manager your Account".

The Registrant's contact data updates will take effect within 1 (one) hour since their introduction.

7.3.2. Updating Registrant's Identification Data

The Registrant's identification data are:

  • for legal entities — company name, legal address, individual taxpayer number,
  • for individuals — first name and surname, passport data, date of birth.

Identification data are updated through an official letter from the Registrant to the Contractor. The form of the letter is available at the Contractor's Web server.
Identification data are updated by an official letter from the Registrant to the Contractor upon identification of the Registrant by the Contractor and on availability of appropriate documents acknowledging the update. The letter form is available at the Contractor's web-server.

The Contractor, upon receipt of such a letter from the Registrant, shall update the Registrant's identification data in the Agreement within 2 (two) working days and notify the Customer thereof.

7.4. Registrant's Data Update to Display in Search Engines

7.4.1. Update of Registrant's Identification Data

If a Registrant is an individual, his/her identification data are concealed from public in search engines. If such, field "person" will display "Private Person" inscription.

7.4.2. Update of Registrant's Contact Data

The Registrant may specify contact data, other than those specified the contract, with the Contractor (telephone number, fax number, e-mail address) to make them available to public.
For any updates to the Contractor's Web server:

  • log into section "Manage your account";
  • select "Review and update data" in menu "Services";
  • find the service with the parameters to be modified;
  • choose necessary link in column "Modify parameters";
  • make necessary changes, and
  • save the changes.

The data in the Registry will be automatically updated within 2 (two) hours upon making appropriate modifications in the contact data.

8. Third-level domain Transfer

8.1. A third-level domain name is transferred to another individual or legal entity on the basis of an notification from the third-level domain Registrant to the Contractor. Sample notifications (letters) and requisite documents for domain transfer are available at the Contractor's web server in the "Services" section.

8.2. If the Contractor receives a notification (letter) from the third-level domain Registrant requesting a transfer of the third-level domain to another individual or legal entity, as well as a confirmation from the individual or legal entity to become the Registrant of this third-level domain, in the form set by the Contractor, the Contractor will transfer the third-level domain within 2 (two) working days and give the previous and new Registrants an appropriate notice. At the Contractor's discretion this term could be extended till 30 calendar days.

8.3. Transfer of a third-level domain name to another individual or legal entity does not affect the term of the registration.

8.4. A confirmation to become the Registrant from the person, issued in the form set by the Contractor and received by the Contractor from this person, shall be deemed as a consent to fulfill the terms and provisions hereunder.

8.5. A third-level domain transfer may be considered void by the Contractor, provided there are sufficient grounds therefore.

8.6. A third-level domain name transfer to another Registrar is not provided by the Contractor:

a) subject to the section 3.3.3 hereinabove;
b) within 60 (sixty) calendar days upon third-level domain ownership transfer from another person.
c) within 60 (sixty) calendar days upon obtaining third-level domain ownership as a result of domain transfer procedure held under the "Third-level Domains Maintenance Policy" and "Third-level Domains Maintenance Policy in COM.RU, NET.RU, ORG.RU, PP.RU Domains".

9. Contractor Transfer

9.1. No second level domain Registrant's (Contractor's) transfer for third-level domains is provided.

10. The Contractor — Partner & Partner — the Contractor Transfer Procedure

10.1. The third-level domain Registrant may transfer the responsibilities to provide the Registrant with the Contractor's services of domain name registration and renewal

  • from the Partner to another Partner;
  • from the Partner to the Contractor.

The third-level domain Registrant may transfer such responsibilities by submitting an official letter or by submitting request using the Contractor's web-server, the section "Manage your account" (the link "Transfer to partner").

10.2. If the Contractor receives such an official letter from the third-level domain Registrant, the Contractor will transfer the responsibilities to provide the Registrant with the Contractor's services of third-level domain name registration and renewal within 2 (two) working days.

If the Contractor receives such request from the third-level domain Registrant, the Contractor will transfer the responsibilities to provide the Registrant with the Contractor's services of third level domain name registration and renewal within one hour from the moment of receipt request.

The Contractor notifies the third-level domain Registrant and the Partner about changes to e-mail addresses specified in the Agreement.
