1. Definitions

1.1. Contractor — Joint Stock Company "Regional Network Information Center". The Contractor's web server is located at https://www.nic.ru/.

1.2. Partner of the Contractor (Partner) — an individual or legal entity that has signed a Multiple Services Contract (a party under the Multiple Services Contract, NIC-REG index).

1.3. Applicant — a person applying to the Partner for the .PW second-level domain registration service (a party under the Service Agreement, NIC-D index).

1.4. Customer — Partner of the Contractor applying to the Contractor for .PW second-level domain registration service for the Applicant's name.

1.5. Sunrise Domain Name Registration — registration of second-level .PW domain names during the period and under the procedure as specified herein.

1.6. Registration Request — an application filed by the Contractor (Accredited Registrar) in the name and on behalf of a Customer for the Sunrise registration of a second-level .PW domain name. Registration Requests may not be assigned by one party to another.

1.7. Evaluation Agent — TM.Biz, which is authorized by P.D.R Solutions FZC, the Sponsor of the PW ccTLD, to verify if the domain name in the Customer's Form complies with the requirements of the PW Policy Guide.

1.8. Form — a form containing the Customer's information required to verify if the the domain name complies with the requirements in section 3 herein and in the PW Policy Guide. The Form is published on the Contractor's website at https://www.nic.ru/catalog/domains/pw/.

1.9. Sunrise Registration Code - unique code given to the Customer by the Evaluation Agent in case of a successful verification of the Form.

2. General Provisions

2.1. This Schedule sets forth the terms and conditions for registration of second-level domains in the PW TLD, and is based on and conforms to the requirements of the ccTLD Sponsor, P.D.R Solutions FZC.

The Contractor acts on the basis of the Agreement with the P.D.R Solutions FZC.

2.2. In any respects that have not been regulated hereunder, the Contractor and the Partner (referred to hereinafter as the Parties) shall be governed by the following documents:

  • gTLD and foreign ссTLD Registration Schedule (Schedule 1/7 to the Multiple Services Contract)
  • gTLD and foreign ccTLD Registration Agreement

2.3. The Parties shall comply with the provisions of the PW Policy Guide, which is published on the Contractor's website at: https://www.nic.ru/dns/domain/en/pw_policy_guide.pdf. Russian version is published at: https://www.nic.ru/dns/domain/pw_policy_guide.pdf. It is understood that P.D.R Solutions FZC is entitled to modify the said document by giving a notice. When construing the said document, its English version shall prevail.

2.4. This Schedule shall take effect on December 3, 2012 and remain valid until February 8, 2013.

2.5. A service order serves as the Customer's full and unconditional consent with the terms of this Schedule, the PW Policy Guide and their amendment procedure. An Order for a service indicates also that the Customer agrees to pay for the service at the price effective at the date the processing of the Order begins.

Documents that set forth the rules for further periods of .PW domain registration and renewal will be adopted solely by the PW TLD Sponsor. The Contractor shall publish the links to the adopted documents as soon as they are published by P.D.R Solutions FZC.

2.6. If any provisions hereof run counter the provisions of the documents specified in clause 2 hereof, the provisions hereof shall prevail.

3. Registration Terms and Conditions

3.1. Sunrise Registration Requests for second-level .PW domains will be accepted from December 3, 2012 until February 8, 2013 inclusive.

The Customer may submit one or more Sunrise Registration Requests for any available .PW domain name that is fully or partially corresponds to the verbal part of the trademark/service mark.

Sunrise requests may be submitted for any available .PW names, meaning names that have not been reserved, restricted, registered, awarded, or otherwise allocated prior to commencement of the Sunrise period under the PW Policy Guide.

3.1.1. Requirements for second-level .PW domain names:

a) the name must consist exclusively of the Latin letters A-Z (case insensitive), the hyphen character and the numbers 0-9;
b) the name cannot begin or end with a hyphen;
c) the name cannot include more than 63 characters (aside from the top level domain extension) and less than 3 characters;
d) Internationalized Domain Names (IDNs) must comply with the IDN policy published at: https://www.centralnic.com/names/domains/idn#rules. e) the name can only have two consecutive hyphens (--) in the 3rd and 4th positions, when preceded by "xn" and followed by a label that corresponds with an internationalized domain name containing characters referred to above.

3.1.2. The registration period of the domain name applied for must be between 2 and 10 years during Sunrise period.

3.2. Terms and Conditions of Sunrise Registration in PW TLD

3.2.1. The Sunrise registration can be performed for a domain name that is fully or partially corresponds to the verbal part of the trademark/service mark registered for any products of services, provided that the following requirements are met:

  • The trademark shall be registered until December 1, 2012 in accordance with the laws of the country where the Applicant conducts its business and shall be effective as of the date of the Registration Request submission to the Registrar.
  • Protected element of the trademark is a word, phrase or combination of letters (hereinafter referred to as "verbal part") that can be expressly and explicitly perceived.
  • If a verbal part of the trademark contains several words separated with spaces, then the Customer is allowed to register a domain name containing the full verbal part without spaces or with hyphens in place of spaces.
  • If a verbal part of the trademark contains special characters (including, without limitation, "@", "!", "§", "%", "^", ".", "©"), then these characters may, at the Applicant's sole discretion, be eliminated from the verbal part of the domain name, transcribed or replaced with a hyphen.
  • If a verbal part of the trademark contains a reference to a company type (such as, without limitation, S.A.S, Ltd. or LLP), then such reference may be eliminated from the domain name.

The Customer may submit a Registration Request for a domain name corresponding to the English translation or transliteration of the verbal part.

The Customer may submit a Registration Request for a domain name containing additional words or characters besides the verbal part.

The Customer may submit a Registration Request for any domain name that sounds similar to the verbal part of the protected element of the trademark.

The Customer may submit a Registration Request for any domain name that is an acronym of the verbal part.

3.2.2. A separate Registration Request must be submitted for each one of the registered trademark's spelling versions.

3.3. During the Sunrise period, the Customer cannot:

3.3.1. transfer domain name support to another Registrar;

3.3.2. transfer registrant rights to any other party, except for the following cases:

  • alienation of the exclusive trademark rights in respect of all the goods and services (for exclusive trademark right holders);
  • legal entity reorganization;
  • inuring of a court ruling related to the domain name rights.

3.4. The service of Sunrise registration of second-level .PW domains includes:

  • submitting a Sunrise registration application to the ccTLD Sponsor for evaluation of a possible domain registration;
  • the domain registration as such.

3.5. The application shall be evaluated by the ccTLD Sponsor. The service of submitting a Sunrise registration application for evaluation shall be deemed provided since the moment the Contractor receives an answer from the ccTLD Sponsor, irrespective of the evaluation result. The money paid for the application evaluation will not be refunded.

3.6. The process of receiving a Sunrise Registration Code by the Applicant

In order to receive a Sunrise Registration Code, the Applicant has to:

a) fill out a Form published at: https://www.nic.ru/catalog/domains/pw/;
b) submit this Form to the Evaluation Agent;
c) if requested by the Evaluation Agent, submit additional information and documents required to evaluate the application;
d) in case of a successful application evaluation, receive the Sunrise Registration Code.

3.7. The process of Registration Request submission

In case of a successful application evaluation, the Customer can submit the Registration Request on the Contractor's website at https://www.nic.ru/catalog/domains/pw/. The Registration Request shall include the domain name and the Sunrise Registration Code received from the Evaluation Agent.

3.8. If two or more Registration Requests meeting all the requirements are received in respect of one domain name during the Sunrise period, the positively evaluated requests will be sent to an auction to be organized by the company authorized by the PW TLD Sponsor. The Contractor shall publish the auction rules immediately after the PW TLD Sponsor adopts them.

4. Payments

The registration fee is specified in the Pricing Schedule (Addendum 2 to the Multiple Services Contract).

The payment procedure is set forth in the documents specified in clause 2 hereof.

5. Registrant's Obligations

The Registrant shall:

5.1. From the moment of record entry into the Registry (the Registrar will notify the Registrant thereof using e-mail) about domain name registration in the name of the Applicant, the latter will undertake all rights and obligations of the Registrant as stipulated by gTLD and Foreign ccTLD Registration Schedule (Schedule 1/7 to the Service Agreement).

5.2. Refrain from using the domain name for the purpose of engaging in any activities prohibited under the laws in effect in the Russian Federation, including dissemination and advertising of pornographic materials, appeals to violence, pursuing any extremist actions, overthrow of power, etc., as well as any activities running counter the public interest or the principles of humanity and morality, or offending the human dignity or religious feelings, etc. It is understood that the Contractor shall be entitled to assess all on its own the Customer's activities as to infringing upon the laws in effect, including any cases when the definition of any such actions is not vested in the legally enforceable enactments. 5.3. The Contractor shall be entitled to suspend the domain name delegation for breaching the provisions of clause 5.2. hereinabove. The domain name delegation may be restored after the Registrant remedies breaches of the provisions hereof.

6. Special Terms & Conditions

6.1. The Contractor reserves the right to change the service terms unilaterally, should the PW TLD Sponsor (P.D.R Solutions FZC) change unilaterally the PW Policy Guide. The Contractor shall notify the Customer and the Applicant of such changes via communication channels and simultaneously publish such changes on the Contractor's web server.

6.2. The changes specified in clause 6.1. hereinabove shall take an immediate effect on the date of publishing.
