Third-Level Domains Maintenance Policy in COM.RU, NET.RU, ORG.RU and PP.RU domainsEffective Third-Level Domains Maintenance Policy in COM.RU, NET.RU, ORG.RU and PP.RU domains (hereinafter referred to as "the Policy") defines users' and Registrar's principal rights and duties arising in connection with third-level domains use in COM.RU, NET.RU, ORG.RU and PP.RU domains. 1. Definitions Domain is an area of the Internet hierarchical name space, which is denoted by a unique domain name, served by a set of Domain Name Servers (DNS), and administered autonomously by its Registrant. Third-level Domain Registrant (Registrant) is a legal entity or individual, on whose name the third level domain was registered. The Registrant's details were retrieved from admin-o field of domain description's form #[DOMAIN TEMPLATE]# of the losing Registrar's database. Third-level Domain Registrant defines the procedure of domain use, is responsible for selecting the domain name and for probable violations of any third party's rights in connection with the selection and use of the domain name, and is liable for the costs of such violations. Cancellation of registration is removal of the information on a domain name and its Registrant from the Registry. Registrar - legal entity JSC "Regional Network Information Center" maintaining data about third-level domains. Registry - central database of COM.RU, NET.RU, ORG.RU and PP.RU domains containing information about registered domain names, Registrants and other information required for domain names registration. Losing Registrar - legal entity RIPN (Russian Institute for Public Networks) that sponsored registration of third-level domain names in COM.RU, NET.RU, ORG.RU and PP.RU domains, submitted relevant details about third-level domains and their registrants to the Registrar on DD.MM.YY. Third-level Domain Delegation means placement and storage of the information about a domain name and its domain name servers (DNS servers) on the root DNS servers of the second level domain, which fact enables the operation of the domain on the Internet. The delegation of a domain with the list of DNS servers, specified by the Registrant, may only be possible within the domain registration period. Third-level Domains Maintenance means entry, made by Registrar into the Registry, of any data related to a domain name and its Registrant based on the information obtained from the Losing Registrar's registration system. A domain name shall be deemed registered from the moment of domain name record entry into the Registry. A registration period during which information about domain name is stored in the Registry will expire on a day indicated in Registrar's Whois listings in 'paid-till' field. A registration period may be renewed for one year from the moment of NIC-D agreement conclusion between the User and Registrar or Registrar's Partner (list of Partners is available on the Registrar's site) for domain name registration. A domain name registration may be canceled ahead of time in cases envisaged by this Policy. Policy Validity period - This Policy has a validity period from December 27, 2010 till the date indicated in Registrar's Whois listings in 'free-date' field, and applies to the Registrants having no NIC-D agreements in place with the Registrar or Registrar's Partner with regard to third-level domain names registrations in COM.RU, NET.RU, ORG.RU and PP.RU domains,. 2. Registrant's and Registrar's Rights and Duties 2.1. The Registrant undertakes to: 2.1.1. Duly fulfill the provisions of this Policy; 2.1.2. Submit to the Registrar the data requested by him for domain maintenance purposes; 2.2. A Registrant is entitled to conclude an agreement with the Registrar or Registrar's Partner before the expiry date of this Policy; 2.3. A Registrant is responsible for selecting the domain name and for probable violations of any third party's rights in connection with the selection and use of the domain name, and bears the risks of losses as a result of such violations. 2.4. A Registrant agrees that domain delegation may be suspended, or domain name registration may be cancelled by the Registrar for the following purposes: 2.4.1. Domain name dispute resolution, 2.4.2. Execution of a court decision, 2.4.3. Suppression of an illegal activity, as well as actions causing damages to third parties, including, but not limited to: distribution and advertising pornographic materials, violence appeals, extremist activities, appeals to overthrowing of government, as well as the activity harmful to public interest, humanitarian and moral principles, insulting human dignity, religious feelings. In this case Registrar has the right for independent assessment of the User's activity in terms of law breaching, as well as in the cases when qualification of such actions is not fixed in statutory acts. Qualification of pornographic materials is published on Registrar's site at http://www.nic.ru/dns/service/hosting/moral_standards.html 2.4.4. Failure of submission of Registrant's data requested by the Registrar within 3 business days since the request submission date. 2.5. The Registrar undertakes to: 2.5.1. Duly fulfill the provisions of this Policy, 2.5.2. Keep domain records within the domain registration period. 2.6. The Registrar is entitled without a prior notification to suspend domain delegation in case of an evident breach, as deemed by the Registrar, of RF legislation by the Registrant. 3. Third-level Domain Delegation Terms & Conditions 3.1. Third-level Domains are delegated with the records transferred from the Losing Registrar's registration system. 3.2. Domain delegation may be suspended on the grounds established by this Policy. 4. Third-level Domain Transfer to Registrar's Registration System Domain transfer means adding Registrant's domain into package of services delivered by the Registrar to the Registrant under the User-Registrar NIC-D agreement. 4.1. Registrar is making a request to the Registrant's contact e-mail obtained by the Registrar from the Losing Registrar. 4.2. The Registrant who received a request and wishing to transfer his/her domain to the Registrar shall make the below actions: a) become familiar with delivery terms and conditions of personal data processing on page https://www.nic.ru/dns/contract-zao/; Therefore, the Registrant generates the request for the NIC-D agreement conclusion. 4.3. Once the Registrant fulfils the above actions, the Registrar concludes the NIC-D agreement based on the information from losing Registrar and provides the access to the Registrant for domain maintenance. In future, domain maintenance will be provided under the Third-level Domains Registration Schedule. 4.4. If no sufficient data is available to enable a domain transfer, the Registrar will independently determine data confirmation procedure about the User and domain transfer procedure to NIC-D agreement. 4.5. Domain ownership transfer to a new Registrant is prohibited within 60 (sixty) calendar days since domain transfer. 5. Domain Name Registration Renewal 5.1. For a third-level domain transferred to the Registrant's agreement, domain registration will be renewed under the procedure set forth in p. 4 of the Third-level Domains Registration Schedule. 5.2. Registration renewal may be provided only under the condition of domain transfer as per p. 4 hereinabove. 5.3. A domain name registration will be canceled by the Registrar, if not renewed by the Registrant within 90 (ninety) calendar days since its expiry date. 6. Data Change 6.1. Change of DNS servers of the domain and other records (A, MX, CNAME), change of Registrant's contact data, change of Registrant's data for viewing in search engines: 6.1.1. is unavailable for a third-level domain not transferred under the procedure defined by p. 4 hereinabove; 6.1.2. is provided under the procedure set forth by the Third-levels Domains Registration Schedule, for a third-level domain transferred under the procedure defined by p. 5 hereinabove. 7. Domains Ownership Transfer 7.1. Domain ownership transfer to a legal entity or individual for the domain name that passed transfer procedure under the procedure set forth in p. 4 hereinabove will be provided under the Third-level Domains Registration Schedule. 7.2. Domains ownership transfer to another person will not be provided in the following cases: 7.2.1. Third-level domain transfer procedure failed; 7.2.2. 60 (sixty) calendar days have not passed since domain ownership transfer under the procedure defined by p. 4 hereinabove. |
